實務灰色地帶
- Working time records: Employers must keep records of all working hours. Failure → labor inspection fines
- "Voluntary" overtime: Courts have challenged practices where employees are pressured to "volunteer" for overtime beyond 150 hours
- Remote work overtime: Tracking overtime for remote workers remains practically difficult
4. 雇主合規重點
- 🟢Track all working hours including overtime with proper records
- 🟢Do not exceed 150 hrs/year ordered overtime without individual agreement
- 🟢Pay overtime premium of at least 25% (or provide compensatory time off)
- 🟢Ensure 11-hour daily rest and 35-hour weekly rest
- 🟢Maximum shift length: 12 hours
- 🟢Night work premium: at least 10%
- 🟢Weekend work premium: at least 10%
- 🟠Monitor CBA provisions that may set higher rates
- 🟠Ensure remote workers' hours are tracked per Labor Code requirements

- 🔴Exceeding 416 hrs/year total overtime: Violates Labor Code
- 🟡Insufficient rest periods: 11-hour daily rest is mandatory; reductions only for specified sectors
- 🟡Unpaid overtime: Common complaint; employers must track and compensate all hours worked
