2. 核心規定

2.1 標準工時 (Standard Working Hours)

2.2 加班規定 (Overtime)

2.3 加班補償 (Overtime Compensation)

2.4 休息時間 (Rest Periods)

2.5 彈性工時 (Flexible Working Arrangements)

🟢 — §85: Flexible working hours (pružná pracovní doba):

  • Employer sets core hours (mandatory attendance) and flexible bands
  • Employee chooses start/end times within flexible bands
  • Average weekly hours must equal standard over a reference period (up to 26 weeks)

🟢 — §86–87: Uneven distribution of working hours:

  • May be agreed for up to 26 weeks (CBA: up to 52 weeks)
  • Weekly hours cannot exceed 48 in any single week (including overtime)

2.6 待命與值班 (On-call / Standby)

🟢 — §95:

  • Standby (pracovní pohotovost): time when employee is ready to work at a place other than the workplace; not counted as working time
  • Compensation: at least 10% of average earnings for standby time
  • Actual work performed during standby → counted as working time (overtime rules apply)

2.7 特殊工時安排 (Special Arrangements)

🟢 — §317: Working from home / remote work:

  • Employee manages own working hours
  • Not entitled to overtime pay, night work premium, or standby compensation unless otherwise agreed
  • Flexi-amendment (2025) introduces enhanced remote work rules
