2. 核心規定

2.1 標準工時 (Standard Working Hours)

🟢 — Mt. §92:

2.2 加班規定 (Overtime)

2.3 加班補償 (Overtime Compensation)

2.4 休息時間 (Rest Periods)

🟢 — Mt. §103–106:

EU comparison: Hungary's 48-hour weekly rest significantly exceeds the EU Directive's 24-hour minimum.

2.5 彈性工時 (Flexible Working Arrangements)

🟢 — Mt. §93: Working time frame (munkaidőkeret):

  • Reference period: up to 4 months (CBA: up to 6 months; further extension to 12 or 36 months for specific sectors with CBA)
  • Hours balanced over the reference period; no overtime premium if total hours within the frame equal scheduled hours
  • Maximum daily working time within a frame: 12 hours

🟢 — Flexible working hours (kötetlen munkarend):

  • Employee determines own daily schedule
  • Must still observe daily/weekly rest periods
  • Must be agreed in writing

2.6 待命與值班 (On-call / Standby)

🟢 — Mt. §110–112:

  • On-call (készenlét): employee ready to work outside the workplace
  • Compensation: at least 20% of base salary for on-call time
  • Standby at workplace: at least 40% of base salary
  • Actual work during on-call → regular working time (overtime rules apply)

2.7 特殊工時安排 (Special Arrangements)

🟢 — The "slave law" amendment (2018) controversially expanded the working time frame to up to 36 months under collective agreements, and increased voluntary overtime from 250 to 400 hours. This remains in effect but has been politically contentious.

🟠 — In practice, few employers use the full 36-month frame or 400-hour overtime cap due to workforce resistance and union opposition.

2018 "Slave Law" Controversy

The 2018 amendment allowing up to 400 hours of overtime and 36-month working time frames provoked significant protests. While legally in force, its practical use remains limited.
