工資與最低工資 — Czech Republic (捷克)

Applicable law: Zákoník práce (Labor Code No. 262/2006 Sb.), Government Regulation on minimum wage.
Currency: CZK.
EU context: EU Directive 2022/2041 on adequate minimum wages applies. Czech Republic must ensure minimum wage is adequate by reference to national benchmarks.

2. 核心規定

2.1 最低工資 (Minimum Wage)

🟢 — §111 + Government Regulation:

2025 Rate Amount
Monthly (full-time, 40 hrs/week) CZK 20,800
Hourly CZK 124.40
  • Applies to all employees regardless of sector, age, or nationality
  • Adjusted annually by government regulation (not automatic indexation)
  • The 2025 rate represents a ~10% increase from 2024 (CZK 18,900)

🟢 — Under the flexi-amendment (2025), a new mechanism ties future minimum wage increases to a percentage of the average wage, moving toward automatic indexation.

🔴 — The exact formula and implementation timeline for automatic indexation remain under legislative discussion.

2.2 保障工資 (Guaranteed Wage)

🟢 — §112: The "guaranteed wage" (zaručená mzda) system sets 8 levels of minimum pay based on job complexity:

Level 2025 Monthly Rate Examples
1 CZK 20,800 Unskilled manual labor
2 CZK 21,000 Simple clerical work
3 CZK 23,200 Skilled trades
4 CZK 25,600 Specialized technical work
5 CZK 28,300 Professional roles
6 CZK 31,200 Managerial/expert roles
7 CZK 34,500 Senior management
8 CZK 38,100 Executive/top specialist

🔴 — Exact 2025 guaranteed wage levels for levels 2–8 are approximations; official rates are set by government regulation.

🟠 — Many employers, especially in Prague, pay significantly above guaranteed wage levels due to labor market competition.

2.3 工資支付 (Wage Payment)

🟢 — §141–142:

  • Payment at least once per month, on a fixed payday agreed in advance
  • Must be paid in Czech Koruna (CZK) unless otherwise agreed for cross-border work
  • Payment by bank transfer or in cash (employee must consent to cash payment)
  • Wages must be paid during working hours at the workplace if paid in cash
  • Payday: if it falls on a non-working day, wages must be paid on the preceding working day

🟢 — §143: Employer must provide a written pay slip (výplatní lístek) showing:

  • Gross salary components
  • Deductions (taxes, social/health insurance)
  • Net pay

2.4 工資扣除 (Wage Deductions)

🟢 — §145–150:

  • Deductions only for: taxes, social/health insurance, court-ordered garnishments, advance payments, trade union dues (with consent)
  • Written agreement required for any voluntary deductions
  • Deductions cannot reduce pay below a protected minimum (subsistence level)

2.5 加班費與附加費 (Overtime & Supplement Pay)

🟢 — (Cross-reference to 02-working-hours-overtime):

Type Minimum supplement
Overtime 25% of average earnings
Night work (22:00–06:00) 10% of average earnings
Saturday/Sunday 10% of average earnings
Public holiday 100% of average earnings (or compensatory time off)
Difficult working conditions Amount per government regulation

2.6 工資保護 (Wage Protection)

🟢 — §324: In case of employer insolvency, employees' wage claims are prioritized. The state guarantees payment of outstanding wages (up to 3 months) through the insolvency wage guarantee fund.

🟢 — Act on Protection of Employees in Employer Insolvency (No. 118/2000 Sb.) provides for state compensation of unpaid wages.

3. 立法理由與實務見解

EU Adequate Minimum Wage Directive (2022/2041)

The EU Directive does not mandate a specific minimum wage level but requires member states to ensure adequacy through:

  • Reference to national indicators (60% of median wage, 50% of average wage)
  • Regular updates
  • Involvement of social partners

Czech minimum wage at CZK 20,800/month is approximately 42% of the average wage — below the EU's 50% benchmark. The flexi-amendment's automatic indexation mechanism aims to address this gap.

實務灰色地帶

  • Guaranteed wage enforcement: Many employers are unaware of the 8-level system and pay only the minimum wage for skilled positions
  • Wage discrimination: Pay gaps between Czech and foreign workers in the same roles remain a compliance concern
  • "All-in" salary packages: Some employers include overtime premium in the base salary — this is permissible only if the overtime portion is clearly separated

4. 雇主合規重點

  • 🟢Pay at least CZK 20,800/month (or CZK 124.40/hour) for full-time work
  • 🟢Apply guaranteed wage levels based on job complexity
  • 🟢Provide written pay slips each pay period
  • 🟢Pay at least monthly on a fixed payday
  • 🟢Deductions only with legal basis or written consent
  • 🟢Overtime and supplement pay at statutory minimums
  • 🟠Monitor annual minimum wage updates (typically effective January 1)
  • 🟠Ensure "all-in" salaries clearly distinguish base pay and overtime components
